Welcome to IS—AY. The terms “we,” “us,” and “our” refer to IS—AY. We operate this website and the associated services, including all related information, content, features, tools, and products, in order to provide you, the customer, with a curated shopping experience (the “Services”). These terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.

We have made every effort to provide an accurate representation of our products in our online store. However, please note that colours or product appearance may differ from how they appear on your screen due to your device settings and configuration.

All our products are made to order. We do not warrant that the appearance, colour, or finish of any product purchased by you will be identical to that depicted or rendered in our online store, given the handmade nature of each piece.

All descriptions of products are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any product we offer.

Section 3 – Orders

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline your order for any reason, at our discretion. Your order is not accepted until we confirm acceptance, generally by way of an order confirmation email. We must receive and process your payment before your order is accepted.

Because each piece is made to order, please review your order carefully before submitting, as we may be unable to accommodate changes or cancellation requests once production has begun. In the event we are unable to accept, change, or cancel an order, we will attempt to notify you using the email address, billing address, or phone number provided at the time the order was made.

Your purchases are subject to return or exchange solely in accordance with our Delivery & Returns policy.

You represent and warrant that your purchases are for your own personal use and not for commercial resale.

Section 4 – Prices and Billing

Prices, discounts, and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed, and will be set out in your order confirmation email. Unless otherwise stated, posted prices do not include shipping, handling, customs, or import charges.

Prices posted on the Site may differ from prices offered through other channels, including our Instagram page or in-person, where applicable. We may, from time to time, offer promotions or discount codes on the Services that may affect pricing and that are governed by terms and conditions separate from these Terms. If there is a conflict between the terms of a promotion and these Terms, the promotion terms will govern.

You agree to provide current, complete, and accurate payment and contact information for all purchases made on the Site. You agree to promptly update your account and other information, including your email address and payment details, so that we can complete your transactions and contact you as needed.

Payment is processed by our third-party payment processor. You represent and warrant that: (i) any payment information you provide is true, correct, and complete; (ii) you are duly authorised to use the payment method provided; (iii) charges incurred by you will be honoured by your bank or payment provider; and (iv) you will pay all charges incurred at the posted prices, including applicable shipping, handling charges, and taxes.

Section 5 – Shipping and Delivery

Please refer to our Delivery & Returns policy for information on shipping timelines, charges, and our return and exchange process. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by our courier partner, customs processing (for international orders, where applicable), or events outside our reasonable control. Once we hand over a product to our courier partner, risk of loss passes to you, though we will assist in resolving any delivery issues in accordance with our Delivery & Returns policy.

Section 6 – Intellectual Property

Our Services, including all trademarks, brand name, text, images, graphics, product photography, and the design, selection, and arrangement thereof, are owned by IS—AY and are protected by applicable intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any material on the Services without our prior written consent.

“IS—AY,” our logo, and our product names are trademarks of IS—AY. You must not use these without our prior written permission.
